The Buyer
hereby authorizes the company or its agents and/or assigns to electronically deduct/process on or after the due date for each consecutive billing cycle tuition payments directly from the following bank or credit/debit card accounts according to the terms of this agreement and to resubmit returned/declined items without prior notice. This payment information will be used to collect any balances past due according to the terms.
I, {name}, am enrolling in Fox House Martial Arts’s AUTOPAY program starting on the date specified herein, and will be allowed to participate in unlimited, regularly scheduled training sessions. I hereby represent that I am at least 18 years of age and physically fit to receive and participate in the prescribed course of instruction.
I understand and agree that upon signing this agreement, I become enrolled at Fox House Martial Arts as a student of a martial arts school, and I agree to abide by all the membership rules, regulations, and schedules of Fox House Martial Arts.
I pledge to observe the rules and regulations of Fox House Martial Arts, or any of its advertised names, its staff, instructors, owners (collectively hereafter referred to as “Fox House")
I understand that Fox House Martial Arts is a private school, and that my membership may be revoked at any time, for ANY reason by Fox House including, but not limited to any behavioral/conduct issues, physical and medical conditions or communicable diseases that were not apparent at the time of enrollment that pose a threat, hazard or offense to myself, other members, staff, guests, or owners of Fox House Martial Arts.
I understand and agree that if I report to Fox House a medical or communicable disease that poses a threat or hazard or offense to myself, other members, staff, guests, or owners of Fox House Martial Arts, I am required to seek medical care, obtain a diagnosis and treatment plan from a licensed medical doctor, and submit to Fox House Martial Arts. The treatment plan must include a licensed medical doctor’s clearance of when, why and how I may return to training without subjecting other members, guests and Fox House Martial Arts to any risk.
I understand and agree that if the above is not complied with, Fox House Martial Arts reserves the right to take action to protect the health and safety of all members, guests, and Fox House Martial Arts, including, but not limited to preventing entry to and/or train at the facilities or revoking my membership. I understand that the class schedule, school rules and staff are subject to change at any time, and that classes may be canceled at any time for any reason at the sole discretion of Fox House Martial Arts. Fox House Martial Arts will provide competent martial arts instruction and suitable facilities to teach lessons.
I understand that I am fully responsible for my attendance, and that I am not eligible for any refunds or credit for canceled or missed classes.
PAYMENT TERMS
I promise to pay the agreed amount in equal monthly payments from the date specified in this agreement and give Fox House Martial Arts and/or its authorized agents or firms engaged in the business of processing check, charge card or credit card debits, full authority to automatically deduct my monthly tuition payments from my CC/Bank account listed on file.
I also promise to pay the one-time, non-refundable registration fee at the time of enrollment if applicable.
This authority is to remain in full force and effect until I terminate my enrollment per cancellation policy stated below. The amount of my membership level chosen is to be debited from my account monthly, commencing on my start date specified in this agreement.
I understand and agree that I can terminate this agreement at any time with a 30-day notice. I understand and agree that I must follow the termination policy as listed below. This authority is to remain in full force and effect until I terminate my enrollment per cancellation policy stated below.
UNPAID BALANCES: I understand and agree that I will not be permitted to use any part of the school until all fees are current. Fox House Martial Arts reserves the right to charge balances and overdue balances to my current account or secondary account under the Electronic Funds Transfer Authorization.
I also understand and agree that if any check or credit card charge payable to Fox House Martial Arts is declined, Fox House Martial Arts will assess a $25 charge for each decline.
I understand and agree that to the extent that Buyer and Member is not the same person, I shall be obligated to make all payments that Buyer fails or has failed to make.
I am not eligible for any credit or forgiveness of overdue balances because they missed classes or failed to utilize the services provided by Fox House Martial Arts.
I understand that Fox House Martial Arts reserves the right to deactivate my membership if my account becomes more than 30 calendar days delinquent.
SUSPENSIONS or CANCELLATION REQUESTS:
MEMBERSHIP HOLD POLICY
Members may request to place their membership on hold in 30-day increments, for up to a total of 90 days per calendar year, by submitting a written request to Fox House Martial Arts.

A Membership Hold Fee of $25 per 30-day period will be charged to maintain the member’s current rate and status.

Members may choose a hold duration of 30, 60, or 90 consecutive days.

The hold begins on the requested start date and will automatically terminate at the end of the selected period, at which point regular billing will resume.

Hold requests must be submitted in writing via email to foxhousemartialarts@gmail.com with the subject line “PAUSE REQUEST – [Full Name]” and include the desired hold start date and duration.

Requests must be received at least seven (7) days prior to the next billing date to be processed in time.

Hold requests may not be backdated, and membership use is not permitted during the hold period.

The Membership Hold Fee is non-refundable and is charged at the beginning of the hold period.

If a member does not return to training or contact Fox House Martial Arts within fifteen (15) days following the end of a hold, the membership may be marked inactive and any grandfathered pricing or promotional rates may be forfeited.
Medical Exceptions
In the event of illness or injury, the Membership Hold Fee may be waived upon submission of a licensed medical professional’s note. Medical holds may exceed 90 days if renewed monthly with updated documentation.
The Membership Hold does not constitute a cancellation of the membership. Members wishing to cancel must follow the cancellation policy outlined in this agreement.

I understand and agree that the 30-day notice and Cancellation notice is required, regardless of any reason, including but not limited to job relocation or injuries sustained in or out of Fox House Martial Arts
I understand and agree that I am not eligible for a refund for the regularly scheduled auto payments that were made prior to the cancellation.
Requests to cancel by telephone (voice, voicemail, or text message) are not accepted.
Any fees already collected prior to the date of the cancellation request, per cancellation policy, are non-refundable.
Upon receipt of the written notice, I understand and agree that Fox House Martial Arts will charge the next scheduled auto-payment (the 30-day notice period) to the credit card account on file.
I understand and agree that this written notice is required, regardless of any reason, including but not limited to job relocation or injuries sustained in or out of Fox House Martial Arts
I understand that I am allowed to use Fox House Martial Arts services during the 30-day period.
I UNDERSTAND THE ABOVE SUSPENSIONS & CANCELLATION REQUEST POLICY
TRANSFERS OF MEMBERSHIP: Membership may not be transferred.
BUYER’S OBLIGATIONS: I understand and agree that I shall not be relieved of Buyer’s Obligations to make payments agreed to, and no deduction from any payments shall be made because of my failure to use the school facilities. (Member dues are for the period of time and are in no way related to actual usage of the school.)
ENTIRE AGREEMENT: Except for the rules, regulations, and schedules posted at the school or issued orally by Fox House Martial Arts from time to time at its discretion, all of which are incorporated into this agreement, this agreement constitutes the entire and exclusive agreement between the parties relating to the subject matter herein and supersedes any oral or other written understanding. This agreement may only be modified in writing executed by a duly authorized representative of Fox House Martial Arts. Employees are not authorized to make any independent agreements with any Member/Buyer
RULES, REGULATIONS, AND SCHEDULES: I understand and agree that upon signing this agreement I become enrolled in Fox House Martial Arts as a student of a martial arts school, and I agree to abide by all the membership rules, regulations, and schedules of Fox House martial Arts, which may be posted at the school or issued orally, and which may be amended from time to time, at Fox House Martial Arts’s sole discretion.

The treatment plan must include a medical doctor’s clearance of when and how I may return to training without subjecting other members, guests, and Fox House Martial Arts to any risk of injury and/or illness. I understand and agree that if the above is not complied with, Fox House Martial Arts reserves the right to take action to protect the health and safety of all members, guests at Fox House Martial Arts, including but not limited to preventing entry to and/or train at the facilities or revoking my membership.
INJURY WAIVER: I acknowledge, and I am fully cognizant of all the inherent dangers in connection with the execution of Martial Arts, and acknowledge that the execution of Martial Arts requires physical physical exertion and contact, and realize that there is a risk of physical injury, disability, full or partial, or death which may be incurred while engaged in this activity. I hereby waive any and all claims for any physical injury, disability and death in connection with the training at the school and expressly assume the risk of all dangers or injury inherent to the Martial Arts.
ADMINISTRATION: I understand that the class schedule, school rules and staff are subject to change at any time, that classes may be cancelled at any time for any reason at the sole discretion of Fox House Martial Arts.
ATTENDANCE: I understand that I am fully responsible for my attendance, and that I am not eligible for any credit or refund for canceled or missed classes. I also understand and accept that Fox House Martial Arts is in no way responsible for my attendance, and is under no obligation to refund, give me credit for, forgive overdue balances or amend any terms of this enrollment agreement due to my missed classes.
SCHOOL RULES AND STUDENT ETIQUETTE
Martial arts are dangerous. Techniques learned at Fox House Martial Arts MUST NOT be used to threaten, bully, provoke, and/or injure others inside or outside of school. Anyone found to be violating this rule will be IMMEDIATELY expelled from our school.
Check in with the instructor before joining a class if late. Proper etiquette must be maintained during class and after class. No profanity, no belching, no disrespectful comments or inappropriate and harassing speech, gestures or actions. This includes rude or harassing behavior of other members on social media platforms. Self-control must be exercised at all times. No chewing gum in class.
Don't coach your partner. Unless your partner's actions present a clear and present threat to themselves or you, stay humble, and let them train. If you have concerns, get Coach's attention and let them handle it.
Clean and appropriate gear and attire are required. Muay Thai or MMA shorts, Ranked or appropriately colored BANG Muay Thai T-shirt, tank tops, spats or athletic leggings.
You must have your own set of all required safety equipment (gloves, shin guards, groin protector, mouth guard, etc).
Remove all jewelry before training, especially hoop earrings, nose rings and watches.
Proper hygiene is required for all classes. Keep fingernails and toenails clipped and make sure ALL your gear and attire are clean and free of any odors.
All used equipment must be put in the proper manner when class is finished. Equipment should not be thrown on the floor/mat.
Students exhibiting the flu or cold-like symptoms, rashes, or any other sign of communicable disease will not be allowed to participate in any classes or training sessions. In order to protect the health, wellbeing, and safety of all members, Fox House Martial Arts reserves the right to request documentation of treatment, completion of treatment and resolution of illness prior to returning to the facilities and to training.
Inclement Weather Policy: Any time inclement weather poses safety risks, Fox House Martial Arts may be closed. Please check your email and/or our social media pages for updates and announcements.
Conduct: We are an alcohol and drug free zone and establishment. Alcohol and illegal drug use (street or prescription) is prohibited in any of the school facilities and premises during and outside of business hours. This includes outdoor group events that are sponsored by Fox House Martial Arts.
Dissemination of any materials or any other activity that other members, staff and management may deem to be offensive or could subject the school to liability based on harassment or any other type of hostile working and training conditions, including, without limitation, pornographic, sexual, racial, and similar nature, materials or activities is prohibited.
We are a private school, and reserve the right to revoke a membership due to the breaking of our school rules.
SPARRING RULES & GUIDELINES
Sparring is not mandatory but members are encouraged to participate and practice safe sparring habits and always take care of each other. Generally it is recommended that you have 3 months of training experience before participating in sparring sessions.
In order to participate in any sparring session, you must have your own proper safety gear, NO EXCEPTIONS:
- Shin guards (full shin guards, slip on cloth style not allowed)
- Mouth piece (must fight tight without falling out))
- Approved sparring gloves (4 oz MMA, 10, 12, or 16 oz)
- Groin protector (men)
- Headgear, elbow pads, knee pads (as needed)
You are fully responsible for your own sparring gear. Equipment that is broken, worn out, or contains odors will not be accepted.
Sparring must be done in a controlled fashion. This includes agreed upon contact level between participants AND THE SUPERVISING coach. No malicious intent, anger or unnecessary aggression when sparring. Your sparring partners are your teammates, not opponents. You are responsible for each other. It is your responsibility to be familiar with the sparring rules.
To protect your safety and the safety of your partners, we have a ZERO TOLERANCE approach to unnecessary aggressiveness and abusive or malicious behavior.
Sparring must be approved by the head coach first and gear must be inspected before participating in sparring.
LOST & FOUND POLICY
In order to maintain a sanitary training environment, we must remove any unclaimed or unattended items, particularly those containing bodily fluids, such as mouthpiece, hand wraps, and wet clothing from the bathroom, training mats, lobby floors, benches and counters. Please be courteous and responsible, and observe the following:
Any unclaimed items such as clothing, training equipment, personal items etc. that are sweaty and/or contain bodily fluids and odors can not be placed in Lost & Found and will be disposed of immediately. Fox House Martial Arts will not handle or hold on to any items described above. All items found that appear clean and free of odors will be placed in the Lost & Found bin throughout the day.
I waive Fox House Martial Arts and all its agents of any and all responsibility over unclaimed and lost items that are disposed of according to the policy stated above. I understand and agree that it is my responsibility to secure all of my belongings, and that Fox House Martial Arts is in no way responsible for lost items.
Assumption of Risk and Waiver of Liability Relating to Coronavirus/Covid-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. Covid-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Fox House Martial Arts cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending classes could increase your risk and your child(ren)’s risk of contracting Covid-19.
By signing this agreement, I acknowledge the contagious nature of Covid-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending classes and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the gym may result from the actions, omissions, or negligence of myself or others, including, but not limited to, employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death) illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the gym or participation in gym programming (“Claims”.) On my behalf, and on behalf of my children, I hereby release, covenant not to use, discharge, and hold harmless Fox House Martial Arts, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Fox House Martial Arts, its employees, agents, and representatives, whether a Covid-19 infection occurs before, during, or after participation in any program.
PHOTO RELEASE
I hereby grant Fox House Martial Arts permission to use my or my child’s likeness in a photograph, photographs, video recordings in any and all of its publications, including website entries, social media, and promotional materials, without payment or any other consideration. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph, photographs, or video recordings. I understand and agree that these materials will become the property of Fox House Martial Arts.
I read and understand all the above policies and guidelines, and I agree to comply with them. I acknowledge Fox House Martial Arts and all its agents have the right and authority to enforce the policy and guidelines stated above. In addition, I waive Fox House Martial Arts and all its agents of any and all responsibility over the consequences of my negligence to follow the policy above.
